Shopping Spree Contest Rules
OFFICIAL SWEEPSTAKES RULES
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Sponsor: This “Chicago Shopping Spree Contest” (the “Contest”) is organized by Peaches Boutique, 5915 S Archer Ave,Chicago, IL 60638 Neither Facebook, Instagram, nor any other social media platform is affiliated with, or a sponsor of this Sweepstakes.
Eligibility: The Contest is open to legal U.S. residents who are thirteen (13) years of age or older at the date of entry. A MINOR MUST HAVE HIS/HER PARENT’S OR LEGAL GUARDIAN’S PERMISSION TO ENTER. Directors, officers, management, employees, other staff and family members of Peaches Boutique or Morilee or any of its affiliated companies, and other persons involved in this Contest are not eligible to enter. The Contest is subject to all applicable federal, state, municipal, territorial, and local laws and regulations and is void where prohibited by law.
Entrant and entrant’s guests may be required to sign Releases for photography or filming for promotional purposes that may include but is not limited to feature on social media and other marketing purposes. If the entrant is a minor, his/her legal guardian will be required to sign Releases and any necessary consent forms granting minor permission to participate in photography or filming. Failure or unwillingness of entrant and/or entrant’s legal guardian to sign any necessary Release and consent forms may, at Peaches Boutique and Morilee sole discretion, result in disqualification.
Agreement to Rules: By participating, you (and your legal guardian if entrant is a minor) agree to be fully unconditionally bound by these rules, and you (and your legal guardian if entrant is a minor) represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Peaches Boutique as final and binding as it relates to the content. Winning the prize is contingent upon fulfilling all requirements set forth herein. The winner (and his/her legal guardian if potential winner is a minor) and accompanying guest may be required to provide a written acknowledgement of acceptance of all terms and conditions of the Official Contest Rules before receiving prize. Peaches Boutique failure to enforce any term of these Official Sweepstakes Rules shall not constitute a waiver of that or any other provision.
Entry Period: The Contest begins on Monday February 11th, 2019 at 12:00am EST and ends on Feburary 15th, 2019 at 11:59pm EST (the “Entry Period”). Entries that are submitted before or after the Entry Period will be disqualified. Peaches Boutique reserves the right to change, vary, postpone, reschedule, or extend the dates of the Entry Period or cancel the Sweepstakes or at its sole discretion.
How to Enter: The Chicago Shopping Spree Contest methods of entry are:
1. a) Submit the entry form via the official webpage at /pages/contests (or through a unique URL provided by us) by submitting the required fields and reading and agreeing to the Official Rules. You may additionally opt in to receive emails from Peaches and Morilee but this will in no way affect your chances of winning.
2. b) To enter by email without obligation, go to the official webpage at /pages/contests and read and agree to the Official Rules. Send an email to support@peachesboutique.com with “Shopping Spree Entry” in the subject line and your name and email address and the statement “I have read and agree to the Official Rules” in the body of the email. Only one email entry per person.
The entry must fulfill all requirements, as specified, to be eligible to win the prize. Entries that are not complete, unreadable, unintelligible, lewd, offensive or do not adhere to the rules or specifications may be disqualified at the sole discretion of Peaches Boutique. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your entry may be removed from eligibility at the sole discretion of Peaches Boutique. Peaches Boutique l, at its sole discretion, may disqualify any Entry for any reason.
Prizes: For One (1) Winner. If winner is a minor under the age of 18, winner MUST be accompanied by legal guardian as their guest. Guest MUST be over the age of 18, whether or not winner is a minor. Winner picked 2/16/19 and has 24 hours to accept prize or another winner will be chosen.
· VIP appointment for you and a guest at the Peaches Boutique Chicago Store (appointment to be scheduled)
· Round trip economy transportation for two to Chicago Midway Airport with a maximum layover of 1 stop, up to $400 per person, arranged by Morilee and Peaches.
· One hotel room for two guests for two night stay in Chicago, arranged by Peaches Boutique and Morilee (up to $600 in value).
· A Morilee dress of your choice, up to $750 value.
No purchase necessary; however any additional costs associated with the entrant and their guest attending the VIP appointment at Peaches store or any other entrant and/or guest expenses, are entirely the responsibility of the entrant and guest.
Approximate retail value of prize is $2,500. The prizes, or any unused portion thereof, are non-transferable or exchangeable, cannot be returned, and cannot be taken as cash and may not be sold, bartered or auctioned. No prize substitutions allowed, except by Peaches Boutique, who reserves the right to substitute any listed prize for one of equal or greater value for any reason. Any prize won by a minor may be awarded in the name of the minor’s parent/legal guardian at Peaches Boutique sole discretion. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Winner may be required to provide a W-9 to Peaches Boutique before receiving prize. All prizes given away by Peaches Boutique are "as is" with no warranty, representation or guarantee relative to the prize, express or implied by Peaches Boutique. Peaches Boutique will not replace any lost or stolen prizes. The use or redemption of prize is subject to any partner or third-party issuer’s official terms and conditions. If winner is unable to attend the appointment at the Peaches Boutique store all prizes will be forfeited and no refund or compensation of any kind will be issued. In the event that a potential winner of a Contest prize is disqualified or forfeits prize for any reason, Peaches Boutique will not be obligated to award a prize.
Odds: The odds of being selected depend on the number of entries received during the Entry Period. Each entry has an equal chance of winning.
The Selection Process: On or about February 17th, 2019 Peaches Boutique will select the winner in a random drawing from among all eligible entries received.
The winner will be notified via the email address provided on February 17th, 2019 or as soon as possible after the Sweepstakes is closed. In the event that Peaches Boutique cannot for any reason get in contact with the winner within 72 hours after notification, or the winner is disqualified for any reason, the winner forfeits prize and Peaches Boutique reserves the right to select another winner at Peaches Boutique sole discretion. Each subsequent winner has 48 hours after notification to respond before a new winner is chosen.
Peaches Boutique decisions as to the administration and operation of the Sweepstakes and the selection of the winner are final and binding in all matters related to the Sweepstakes and no correspondence will be entered into by Peaches Boutique l in this regard. In the event of a dispute regarding the identity of the person submitting an entry, Peaches Boutique reserves the right to determine identity of entrant in its sole discretion.
No responsibility can be accepted for entries that are not registered or received for any reason. Incomplete entries will be disqualified. Peaches Boutique explicitly reserves the right to refuse or remove a submission of an entrant, at their sole discretion, in the event that Peaches Boutique determines that an entrant does not comply with all rules and regulations as contained herein.
If for any reason any aspect of the Sweepstakes is not capable of running as planned, including by reason of infection by computer virus, telephone network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of Peaches Boutique l, Peaches Boutique reserves the right, in their sole discretion to cancel, terminate, modify or suspend the Sweepstakes, or invalidate any affected entries. Peaches Boutique reserves the right (in their sole discretion) to disqualify any individual it finds to be tampering with the entry process or operation of Peaches Boutique, or to be acting in violation of these terms and conditions or in an unsportsmanlike or disruptive manner.
Use Of Personal Information: Peaches Boutique l will collect personal information obtained from the entrant’s entry to conduct this Sweepstakes and may, for this purpose, disclose such information to third parties. If entrant chooses to opt in to receive Peaches Boutique emails on the entry form, entrant will be signed up for Peaches Boutique email lists. Entrant can remove themselves from this list at any time by following the “unsubscribe” link at the bottom of Peaches Boutique emails.
Entrants (and his/her legal guardian if entrant is a minor) and guests consent to the disclosure of their name, likeness, images, social media handles, city and state for the purpose of publishing prize winner's details and any other media and promotional actions. Peaches Boutique may also use the personal information for promotional marketing and publicity purposes including, but not limited to website use, in electronic messages and newsletters, or use on social media outlets, without further notice.
Entrants (and his/her legal guardian if entrant is a minor) and guests agree to take part in additional unpaid publicity (including photo/video shoots and interviews) accompanying or resulting from this prize should Peaches Boutique require them to do so. Such publicity may include their names and/or likenesses and may include (but is not limited to) online and print promotional marketing.
Entrants should direct any request to access, update or correct their personal information to Peaches Boutique. All personal information will be held and dealt with in accordance with the Peaches Boutique Privacy Policy, which is available at: https://www.promgirl.com/info/privacy. All entries and any copyright subsisting in the entries become and remain the property of Peaches Boutique
Release: Winner and any guests will be required to execute any further legal agreements, affidavidts, forms, documents, waivers, consents, and/or releases (“Release”) deemed necessary by Peaches Boutique in its sole discretion, before, during or after the prize is awarded. If the winner and/or any guest is a minor, his/her legal guardian will also be required to sign Releases. Releases may include but are not limited to: (i) confirmation of winner’s eligibility for the Sweepstakes and compliance with these Sweepstakes Rules; (ii) confirmation of winner’s acceptance of the Prize as offered; (iii) any and all tax related forms or documents; (iv) Release for any photographing or filming that may take place during redemption of Prize; (v) Release of Peaches Boutique and it’s partners and their respective parent companies, subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, agents, sponsors, administrators, licensees, representatives, advertising, media buying and promotional agencies from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Sweepstakes, participation in any Sweepstakes activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (vi) grant Peaches Boutique the unrestricted right, in Peaches Boutique discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use the winner’s and any guest’s name, photograph, likeness, voice and biography, and any intellectual property owned by entrant in any and all media now known or hereafter devised, for purposes of this and future promotions without further compensation, except where prohibited.
The required executed Releases MUST be returned by the date indicated on the accompanying letter of notification. If the winner and/or guests fails to return such required Releases, or is unwilling to, unable to, or elects not to, the selected winner may, at Peaches Boutique’s sole discretion, be disqualified and the Prize forfeited
Liability: By participating in the Sweepstakes, all entrants and/or winners (and his/her parent or legal guardian if entrant/winner is a minor) agree to release, indemnify and hold harmless Peaches Boutique, and its partners, affiliates, suppliers, distributors, parent companies, and each of their officers, directors, employees, licensees, licensors, shareholders, attorneys, agents, advertising agencies, promotional suppliers, participating vendors or any other company involved, from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize. Entrant (and his/her parent or legal guardian if entrant is a minor) waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Disputes: Each entrant (and his/her legal guardian if entrant is a minor) agrees that (a) any and all disputes, claims, and causes of action arising out of or in connection with a Sweepstakes, or any Prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in Delaware; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Sweepstakes, but in no event any legal or attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages (other than for actual out-of-pocket expenses), and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Sweepstakes Rules, or the rights and obligations of entrant and the Sponsor in connection with a Sweepstakes shall be governed by, and construed in accordance with the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Delaware or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of Delaware.
Miscellaneous: If any part of these Official Sweepstakes Rules is held by a court of competent jurisdiction to be invalid, illegal, or otherwise unenforceable, such part will be modified by such court to the minimum extent necessary to make it enforceable while preserving to the maximum extent possible the original intent of and the remaining parts of these Rules will remain in full force and effect. Nothing contained herein or in any of the Sweepstakes related materials should be construed as an endorsement by Peaches Boutique of any co-sponsor, third party, product, or service.
